Terms of Sales

The organization that owns this website and the Mamba Blades Co brand, stated in the following lines as Mamba Blades, is the property of Vanessa Bernal / Ernesto Zamudio in its entirety, as well as all the rights that correspond to it. Any reproduction, in whole or in part, is systematically subject to the authorization of the owner. However, links of the hypertext type to the site are authorized without specific request.

Acceptance

The customer acknowledges having read, at the time of placing the order, the specific conditions of sale stated and expressly declares to accept them without reservation. These general conditions of sale govern the contractual relationship between Mamba Blades and its client, both parties accepting them without reservation. These general conditions of sale will prevail over all other conditions appearing in any other document, except prior, express and written derogation from Mamba Blades.

Products

The photographs illustrating the products do not enter into the contractual field. If errors are introduced, in no case, the responsibility of Mamba Blades can not be engaged. The majority of the products offered to its customers by Mamba Blades are available in warehouse.

Price

The price is expressed in euros. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed excluding taxes, with non-applicable VAT, under article 293 B of the CGI. This price includes the price of the products, the costs of handling, packaging and storage of the products, the costs of transport and commissioning.

Ordered

Automatic registration systems are considered as proof of the nature, content and date of the order. Mamba Blades confirms the acceptance of his order to the customer at the email address that he will have communicated. The sale will only be concluded once the order has been confirmed. Mamba Blades reserves the right to cancel any order from a customer with whom there is, in particular, a dispute relating to the payment of a previous order. The information provided by the buyer, when taking the order, commits the latter: in the event of an error in the wording of the recipient’s contact details, Mamba Blades cannot be held responsible for the impossibility in which it could be to deliver the product.

Delivery

After order confirmation, Mamba Blades undertakes to deliver to its carrier, all the references available in the warehouse ordered by the buyer and this within a maximum period of 5 working days from the effective payment, except adjustment in the workshop requested by the customer. If, however, one or more products of the order were not available, Mamba Blades would notify the buyer of the delivery time. This carrier undertakes to deliver the order to the buyer’s address stipulated when ordering. In addition, for deliveries outside mainland France, the customer agrees to pay all taxes due on the importation of products, customs duty, value added tax, and all other taxes due under the laws of the country of receipt of the command. All orders placed with Mamba Blades are intended for the personal use of customers, customers or recipients of the products are prohibited from any partial or total resale of the products. Mamba Blades de facto disclaims any legal liability if the payment of taxes was not made by the customer. The delivery will be made by La Poste in colissimo or other carrier in Metropolitan France. Any delays do not entitle the buyer to claim damages. Deliveries in EU countries are made by La Poste in Colissimo Europe or another carrier, for deliveries outside the EU deliveries are made by internal postal services or another carrier.

In the case of a technical product, the customer will take care to carefully check the proper functioning of the device delivered. In the event of apparent defects, the buyer has the right of return under the conditions provided for in this document. War, riots, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure releasing the seller from his obligation to deliver. The goods always travel at the risk and peril of the recipient, insurance is however always included. It is always up to the recipient to check the condition of his package on arrival at the place of delivery and must immediately report any noticeable deterioration. For reasons of availability, an order may be delivered in several installments to the customer. The customer then only pays the delivery costs that he would have paid for the total of his order in one only delivery, the differential remains the responsibility of Mamba Blades. If the customer wants two places of delivery, he places two orders, and pays the delivery costs incurred.

Satisfied or refunded

Paloma Valeva clients have 7 days to form an opinion. In case of exchange or refund, he will have to, after having warned by e-mail, return the new item(s) in its (their) original packaging(s), intact, accompanied by all possible accessories, instructions for use and documentation at the following address:

In the event of an exchange, Mamba Blades will refund the sums paid by the customer, free of charge, with the exception of return costs and financial commissions generated where applicable. In the event of withdrawal, the shipping costs will be deducted from the sums paid. The refund is made within a maximum period of 30 days by check sent to the address indicated when ordering.

The price invoiced to the customer is the price indicated on the order confirmation sent by Mamba Blades Co. Remember that under article 293 B of the CGI, the buyer will not have to pay VAT, which is not applicable. The price of the products is payable in cash on the day of the actual order. Payment is made by credit card bearing the initials CB, VISA, Mastercard, or PAYPAL account, or bank transfer after express authorization from Paloma Valeva. Paloma Valeva’s online payment method allows you to pay via a PAYPAL bank server in a secure environment. The credit card number is therefore directed to the servers of the financial institution, payment is made directly to this institution in a secure environment without going through the server of the Paloma Valeva site, a guarantee that is all the more important as any confidential information is known only to the financial partner (PAYPAL). The order validated by the customer will only be considered effective when the bank payment centers in question have given their agreement. In case of refusal of the said centers, the order will be automatically canceled and the customer notified by e-mail. In addition, Mamba Blades reserves the right to refuse any order from a customer without any justification.

Disputes

This contract is subject to French law. Mamba Blades cannot be held liable for damages of any kind, whether material, immaterial or bodily, which could result from a malfunction or misuse of the products marketed. The same applies to any modifications to the products resulting from the manufacturers. The responsibility of Mamba Blades will, in any case, be limited to the amount of the order and cannot be blamed despite all the precautions taken in the presentation of the products. In case of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of: a professional association of the branch, an association of consumers or any other counsel of his choice. It is recalled that the search for an amicable solution does not interrupt the “brief period” of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the judgment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller. Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution. Otherwise, the Commercial Court of Clermont-Ferrand has sole jurisdiction, regardless of the place of delivery and the method of payment accepted. Guarantee

In any case, Mamba Blades cannot be held responsible for non-compliance with the regulations and laws in force in the country of receipt, the responsibility of Paloma Valeva is systematically limited to the value of the product in question, value on its date. of sale and this without the possibility of recourse to the brand or the company producing the product. In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code). On condition that the buyer proves the hidden defect, the seller must legally repair the consequences (art. 1641 and following of the civil code); if the buyer goes to court, he must do so within a “short time” from the discovery of the hidden defect (art. 1648 of the civil code).
